    'I was going to die' cries 17-year-old boy shot in the face by Colorado town council member

    A Colorado council member allegedly shot a 17-year-old boy in the face in the road in front of his girlfriend's home as the two kids were in the middle of writing a note to ask for permission to take homecoming photos at the home.

    The homeowner wasn't home at the time in Conifer but saw the teens on her security cameras , sending boyfriend Brent Metz, 38, a recently elected Mountain View Town Council member, who also owns the home, to the scene instead.

    He pulled up in his car and grabbed his gun on the way out. Metz ended up shooting the 17-year-old boy in the face in front of his 15-year-old friend. "I was going to die," the teen said from his hospital bed after suffering wounds to his mouth and nose. He remains hospitalized.

    The teen said he didn't think the shot was on purpose , as he "heard the driver (Brent) say 'oh s**t, my gun went off,'" according to the arrest report seen by CBS News.

    The teen says he was simply trying to find a nice place for homecoming photos with his friend, so they ended up hopping over a property fence. After looking around, they returned to their car to write a note asking for permission to use the place as a backdrop.

    Jefferson County Sheriff’s Office said the teen's friend called for help, and Metz remained at the scene until the police arrived. Metz also offered to assist the shot boy but his life-long friend pushed him away and reportedly asked why he shot his friend.

    Authorities found his gun in Metz's car. Metz was arrested and charged with first-degree assault, two counts of felony menacing, illegal discharge of a firearm and two counts of reckless endangerment. A judge set his bond at $5,000.

    Criminal defense lawyer Tyrone Glover told Denver7 it is “categorically unreasonable to me that you think you can shoot a kid in the face through a car window because they’re outside of your property.”

    “Unless there was a threat of serious bodily injury – maybe there was, we don’t necessarily know at this point – but the facts are, as Jeff Co have said – I don’t see any excuse,” he added.

    Colorado's "Make My Day" law allows residents and homeowners to use deadly force if there's an intruder inside the home, but according to authorities, the teenagers were on a public road outside the parameters of Metz’s private property.
