    Texas Uber driver 'punches' elderly man on video during 'argument over legroom'

    Shocking surveillance footage shows the moment an Uber driver punches an elderly passenger from behind following a dispute.

    Dallas police are investigating Wednesday's attack that took place in the Design District . The passenger, 68-year-old Suleman Gauba, said the incident stemmed from a simple argument over legroom.

    "I cannot sit in the back seat," he said. "Very small place, you know?" he told Fox4 in an interview. T he footage shows the Uber driver arrive in a Chevrolet Malibu to pick up an Guaba and his wife at Market Center Boulevard in Dallas.

    Gauba and his wife began get in the back seats, but two-and-a-half minutes pass and the car does not take off. Surveillance video then shows Guaba get out of the car and as he starts to walk around the back of the car he gets sucker punched in the back of his head by the driver before falling to the ground.

    The driver hovered above him while his wife slowly got out of the car, the video shows. Gauba says his complaint about not having enough leg room lead to the Uber driver canceling the ride and telling him to get out of the car.

    "He said, ‘I’m canceling your ride,’" Gauba said. "I just told him, you know, ‘Why are you canceling my ride?’ I don’t know," Gauba recalled. "At that time, my wife told him, ‘I’m calling the cops.’"

    The suspect drove away before police arrived. "I was thinking, you know, what’s happened with me? Why he hit me?" he told Fox4.

    Gauba, a Pakistani immigrant who recently moved to Dallas from New Mexico, says he does not own a car and relied on Ubers to get around. Him and his wife were on their way to a Walmart before the incident.

    The Dallas Police Department is asking anyone with information to contact them. Gauba said he is hoping for justice to be served. "Because he deserves this," Gauba said. "He deserves jail."

    The elderly couple has filed a complaint with the rideshare app and Uber said they are in contact with the rider and are looking into the incident.
