    New California law limits the use of cell phones in schools. Here’s what to know

    A new California law will require public schools to limit or ban the use of cell phones in class.

    On Monday, Gov. Gavin Newsom signed Assembly Bill 3216, also known as the Phone-Free School Act, into law. It takes affect in 2026.

    “We know that excessive smartphone use increases anxiety, depression and other mental health issues — but we have the power to intervene,” Newsom said in a statement on Monday, Sept. 23. “This new law will help students focus on academics, social development and the world in front of them, not their screens, when they’re in school.”

    This legislation aims to reduce distractions and create a more focused learning environment for students, according to the governor’s website.

    Here’s what you need to know:

    Can students use cell phones in school under California law?

    Under California law, public school districts and county education offices currently have the option to restrict or ban cell phone use during school hours.

    However, starting in the 2026 academic year, the new law will make these limitations mandatory.

    “Research continues to demonstrate the potential harms of smartphone use among children,” California State Assembly member Josh Hoover, R-Folsom, said on Monday. “The growing use of these devices in a child’s everyday life can contribute to lower test scores, anxiety, depression, and even suicide.”

    “I am proud our state is taking action to limit the use of smartphones during the school day and protect kids from these harms,” added Hoover, who authored the bill.

    A Pew Research Center survey revealed that 72% of high school and 33% of middle school teachers see cell phone distractions as a major issue.

    How can schools keep kids safe in class?

    AB 3216 faced some opposition from lawmakers, including state Sen. Angelique Ashby, D-Sacramento , who raised concerns about students not having access to their phones during a school shooting or other emergencies.

    “I don’t think kids should be on their phone in class and distracted,” Ashby told The Sacramento Bee in August. “But a bill that could potentially give districts permission to ban kids from bringing their smartphones to school gives me pause.”

    According to the governor’s website, the development of policies under AB 3216 will involve input from students, parents and educators from students, parents and educators to ensure the policies address their needs.

    The policies must allow students to use their phones in case of emergency, such as in response to threats, or when permitted by a teacher, administrator, doctor, or outlined in the student’s individualized education plan.

    “Reducing phone use in schools is essential for minimizing digital distractions and making space for stronger and more meaningful in-person connections,” First Partner Jennifer Siebel Newsom said. “AB 3216 isn’t only about classroom instruction, it’s about protecting the mental health and social and emotional well-being of California’s kids.”
