A SOFTWARE company is involved in an $825,000 settlement after a cyberattack compromised Americans' personal information.

Carvin Software is handing customers up to $8,500, but class members have just over a week left to file a claim.

The data breach occurred between February 22, 2023, and March 9, 2023.

The breach allegedly compromised sensitive information such as Social Security numbers and financial account data.

Class members in the lawsuit claim that the software company failed to implement reasonable cybersecurity measures to protect their information.

Carvin Software hasn't admitted any wrongdoing but agreed to pay the $825,000 settlement to resolve the data breach class action lawsuit.

Those who experience documented losses due to the data breach can claim up to $8,500.

Class members can also receive two years of free identity theft and credit monitoring services.

There is also an option to receive compensation for lost time, which is paid at $20 per hour.

The maximum lost time an individual can claim is four hours, which would be $80.

As well as the $825,000 settlement, Carvin Software will also make $700,000 worth of remedial enhancements to its data security policies.

    WHO IS ELIGIBLE?

Individuals whose personal information may have been compromised in the breach between February 2023 and March 2023 may file a claim.

Losses covered by the benefit include credit expenses, bank fees, fraudulent charges, and identity theft damages.

The deadline to file a claim, however, is fast approaching.

Americans have until August 30, 2024, to submit a valid claim.

Those filing a claim must prove their losses via receipts, bills, invoices, account statements, credit reports, and other documentation of data breach-related losses.

The final approval hearing for the settlement is scheduled for September 25, 2024.

    PAY UP

Other settlements taking place in the US at the moment include TransAm Trucking's $3.75 million settlement, Group 1001's, insurance company, $4.76 million settlement, and LensCrafters's $39 million settlement.

TransAm Trucking was accused of failing to pay wages required by federal law to its drivers.

    What's a class-action settlement?

Class action lawsuits offer groups of people, or 'classes,' a way to band together in court.

These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.

When a suit becomes a class action, it extends to all "class members," or people who may have similar complaints to those who filed the suit.

Companies often settle class actions - offering payment to class members who typically waive their right to pursue further legal action by accepting money.

These payout agreements frequently include statements by the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.

Pollution, discrimination, or false advertising are a few examples of what can land a class action on a company's doorstep.

The company allegedly did not compensate drivers for training or orientation time.

The trucking company didn't admit any wrongdoing but agreed to a $3.75 million settlement.

The deadline to file a claim is in just two days, on August 23.

Those who submit a valid claim will get a payment from a $125,000 settlement fund from the multi-million dollar settlement.

Estimate payouts are expected to be at least $35, but could be more.
