    Mazda drivers file lawsuit over ‘engine defect affecting thousands of cars’ – & brand company’s safety vows ‘untrue’

    AN AMERICAN driver has filed a class action lawsuit against Mazda claiming that the manufacturer sold vehicles with an engine defect.

    The plaintiff , Matt Cauller, filed the suit against the vehicle maker in California .

    Cauller’s lawsuit isn’t the first 2024 class action against Mazda

    The lawsuit states that Mazda Motor of America Inc. has been aware that it’s selling cars to hundreds of thousands of drivers with dangerous engine problems, according to Top Class Actions .

    The class action claims that Mazda failed to disclose that an engine it uses in multiple models is defective.

    “Because of the Engine Defect, Mazda’s advertising about the safety and dependability of the Class Vehicles is untrue and materially misleading,” Cauller’s class action says.

    He said the alleged motor defect caused the engine to leak coolant.

    The issue, in turn, leads to the engine overheating and leads to “catastrophic engine failure.”

    Mazda admitted to the existence of the engine defect, according to the class action.

    A series of technical service bulletins released by the carmaker noted the issues but the manufacturer failed to warn consumers, extend a warranty or issue a recall, the Mazda class action alleges.

    Mazda’s admittedly defective SKYACTIV-G 2.5T engines are equipped in its Mazda6 model years 2018-2021, its 2021-2024 Mazda3, the CX-30, 2016-2023 CX-9, 2019-2024 CX-5 and the 2022-2024 CX-50.

    Cauller looks to represent a class of South Carolina drivers who purchased or leased a class Mazda vehicle with a SKYACTIV-G 2.5T engine in the state.

    “Mazda has long known of the Engine Defect,” the Mazda lawsuit claims.

    “It has amassed years of research, data, and Engine Defect warranty claims.”

    The plaintiff stressed that Mazda is guilty of unjust enrichment and fraudulent omission.

    Additionally, the class action states that the carmaker violates South  Carolina’s Unfair Trade Practices Act and state codes regarding breach of express warranty and breach of implied warranty of merchantability.

    Cauller is pushing for a jury trial for the class action claims.

    He also requested declaratory and injunctive relief and an award of actual and statutory damages for himself and all class members.

    NOT AGAIN!

    This isn’t the first 2024 class action against Mazda, either.

    Earlier this year, a separate class action lawsuit against the manufacturer was filed over claims the automaker sold certain vehicles equipped with defective infotainment systems as well.

    Four plaintiffs filed a class action lawsuit against Mazda in July claiming that infotainment systems in some of its vehicles were allegedly defective causing them to malfunction.

    The consumers stressed that the issue can cause drivers to become distracted.

    The infotainment system in cars includes a number of features like a visual monitor for backup cameras, radio and audio controls, navigation system and cell phone connectivity settings.

    Their Mazda class action lawsuit was filed in Kentucky.

    Mazda did not immediately respond to The U.S. Sun’s request for comment.
