    NOTICE OF TRUSTEE’S SALE

    NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 12, 2004, executed by Borrower, Joyce Partain, to Pam Smoljanovich, Atty, the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 541, at Page 191. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 905 Osborne Dr, Rainelle, WV 25962. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 31, 2023, of record in the Clerk’s Office in Book 880, Page 794. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:

    13th day of September, 2024 at 11:00 a.m.

    All of the following lots or parcels of surface land, together with all improvements thereon and appurtenances thereon and thereto appertaining, being Lots Nos. 115, 116 and 44 feet of the western portion of Lot No. 117, of the Osborne Addition of the Town of East Rainelle, situate in Meadow Bluff District, Greenbrier County, West Virginia, as shown upon a map of said addition of record in the Office of the Clerk of the County Court of Greenbrier County, West Virginia, in Map Book 2, at page 69. The said lots front on Osborne Drive, and the portion of Lot 117 hereby conveyed is more particularly bounded and described as follows: Beginning at a stake on the corner of Lots Nos. 116 and 117 of said Osborne Addition on Osborne Drive; thence in a northeasterly direction and with the division line of Lots Nos. 116 and 117, a distance of 323.9 feet to the back line of said Lots 116 and 117 and the corner thereof; thence leaving Lot No. 116 and with the back line of Lot No. 117 and parallel with Osborne Drive, a distance of 44 feet to a stake; thence in a southwesterly direction through Lot No. 117 and parallel with the division line of Lots Nos. 116 and 117, a distance of 323 feet, more or less to a stake on line of Lot 117 and Osborne Drive; thence with line of Lot No. 117 and Osborne Drive in a northwesterly direction a distance of 44 feet to the point of beginning. There is Excepted and Reserved from this conveyance that certain 28,044 sq. feet portion of Lots 115, 116 and 117, heretofore out-conveyed by Joyce Partain and Derse Pertain, her husband to Londus K. Boothe and Robin Boothe, his wife, by deed dated May 18, 1988, recorded in Deed Book 387, at page 402.

    Being the same property conveyed to Joyce Partain and Derse Partain by the Deed dated September 9, 1960 and recorded in Deed Book 211 at Page 118. Joyce Partain inherited Derse Partain’s interest in the property in Last Will and Testament of Derse Lee Partain recorded June 25, 2004, in Deed Book 54, at Page 469, in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia.

    TERMS OF SALE:

    1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

    2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

    3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

    4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

    5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

    6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
