    WATER TREATMENT PLANT FLOOD MITIGATION

    General Notice

    Town of Alderson (Owner) is requesting Bids for the construction of the following Project:

    Water Treatment Plant Flood Mitigation

    010-10133

    Bids for the construction of the Project will be received at the Town of Alderson located at 202 Monroe St., Alderson, West Virginia 24910, until Thursday, September 26, 2024 at 10:00 a.m. local time. At that time the Bids received will be publicly opened and read.

    The Project includes the following Work:

    Construction of a new 700 gpm packaged water treatment plant, new settling tank, and upgrades to the existing raw water intake pumping station.

    Bids are requested for the following Contract: Water Treatment Plant Flood Mitigation

    The Work will be substantially completed within 570 calendar days after the date when the Contract Times commence to run, and completed and ready for final payment within 600 days after the date when the Contract Times commence to run. Liquidated damages shall be $1,000 per day.

    Bidding Documents may be downloaded from the designated website. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website.

    Prospective Bidders may obtain or examine the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 8:00 a.m. to 5:00 p.m., and may obtain copies of the Bidding Documents from the Issuing Office as described below.

    Printed copies of the Bidding Documents may be obtained from the Issuing Office by paying the amount of each set listed below.

    Bidding Documents may be purchased from the Issuing Office during the hours indicated above. Cost does not include shipping charges. Upon Issuing Office’s receipt of payment, printed Bidding Documents or electronic documents will be transmitted to the prospective Bidder. The shipping charge amount will depend on the shipping method requested. Bidding Documents are available for purchase in the following formats:

    • Bidding Documents issued as hard copy full-size drawings and hard copy specifications, are available for $100.00 per set.

    • Bidding Documents issued as hard copy half-size drawings and hard copy specifications, are available for $70.00 per set.

    A two-envelope system will be used.

    Envelope No. 1 must have the following information presented on the front:

    • Name and address of Bidder

    • Bid on Contract – Water Treatment Plant Flood Mitigation

    • Received by the Town of Alderson

    Envelope No. 2 labeled “Bid Proposal” shall also be placed inside of Envelope #1.

    Envelope No. 1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR – 1 of these contract documents. If such documents are found to be in order, Envelope No. 2 “Bid Proposal”, will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. 1 are not in order, Envelope No. 2 “Bid Proposal” will not be opened and the Bid will be considered non-responsive and will be returned to the Bidder.

    A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids.

    Bids shall be accompanied by a certified check or bid bond payable to Town of Alderson in an amount equal to five percent (5%) of the base bid.

    All Bidders are required to have a West Virginia Contractor’s License per Section §30-42-12 of the West Virginia Code.

    Any Contractor submitting a Bid on this project hereby certifies, indicates and acknowledges that he/she has a license and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed.

    Drug Free Workplace – West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed drug-free workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor’s compliance with the provisions of Article 1D, Chapter 21 of the West Virginia code. Failure to submit the signed drug-free workplace affidavit in the first envelope shall result in disqualification of such bid.

    This Community Development Block Grant project is to be financed in part by a grant from the U.S. Department of Housing and Urban Development (HUD) and the West Virginia Department of Economic Development/West Virginia Community Advancement Division and shall be referred to as Project #010-10133, Town of Alderson – Water Treatment Flood Mitigation.

    Nondiscrimination in Employment – Bidders on this Work will be required to comply with the President’s Executive Order No. 11246 and “HUD Section 109”, which prohibits discrimination in employment regarding race, creed, color, sex, or national origin.

    The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing.

    The parties to this contract agree to comply with HUD’s regulations in 24 CFR part 135, which implement section 3. Bidders’ attention is directed to the Section 3 “Clause” set forth in the contract documents.

    The contractor agrees to include this section 3 clause in every subcontract subject to compliance with regulations in 24 CFR part 135, and agrees to take appropriate action, as provided in an applicable provision of the subcontract or in this section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR part 135. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR part 135.

    Noncompliance with HUD’s regulations in 24 CFR part 135 may result in sanctions, termination of this contract for default, and debarment or suspension from future HUD assisted contracts.

    Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprise participation as described in the Federal Specifications insert to the Contract Documents. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Davis Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, and the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code §21-5A-3.

    Bidders are advised that the Contract awarded under this Advertisement for Bids is to be funded (entirely/or in part) by a grant from the United States Department of Housing and Urban Development (HUD). Neither the United States nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting Contract.

    DBE Requirements – Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents.

    The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.

    Notice of Federal Wage Requirements – Contractors are required to comply with all laws pertaining to federal wage rates as issued in accordance with the Davis Bacon Act. The contractor will be required to pay the federal wage rates appropriate for each worker classification.

    Suspension and Debarment – Recipient shall not entertain the use of businesses that are listed on the “System for Award Management” (SAM) at www.Sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.

    Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders.

    The Town of Alderson reserves the right to reject any and all bids.

    Pre-bid Conference

    A pre-bid conference for the Project will be held on Wednesday, September 4, 2024 at 11:00 a.m. at Town of Alderson located at 202 Monroe St., Alderson, West Virginia 24910. Attendance at the pre-bid conference is encouraged but not required.
