The Biden Administration Challenges the Latest Texas Immigration Law

Texas Governor Greg Abbott will start the year with a new lawsuit against him. This time the Justice Department threatened to sue him if the new Texas law is carried through.

The Justice Department gave Texas until January 3 to say they won’t arrest illegal immigrants.

Governor Abbott signed the law on December 18 in Brownsville according to AP News. This region of Texas is one of several crossing paths migrants used to enter the State.

The governor said according to a press release:

"President Biden’s deliberate inaction has left Texas to fend for itself. Today, I will sign three laws to better protect Texas—and America—from President Biden’s border neglect."

"These laws will help stop the tidal wave of illegal entry into Texas, add additional funding to build more border wall and crackdown on human smuggling."

The Justice Department said according to The Texas Tribune it would:

“pursue all appropriate legal remedies to ensure that Texas does not interfere with the functions of the federal government.”

In a letter addressed to Governor Abbott, the department said according to The Guardian:

“Senate Bill 4 is preempted and violates the United States Constitution. Accordingly, the United States intends to file suit to enjoin the enforcement of Senate Bill 4 unless Texas agrees to refrain from enforcing the law. The United States is committed to both securing the border and ensuring the processing of noncitizens consistent with the Immigration and Nationality Act (INA). Senate Bill 4 is contrary to those goals.”

Governor Abbott will probably continue with his plan since he has not formally addressed this new lawsuit, yet.
