Giuliani's Bold Appeal: Why He Wants Trump's Charges Dismissed

Former President Donald Trump asked the court to drop several criminal accusations against him in the Georgia 2020 election interference case.

Trump's filings serve as his initial round of legal defenses against the state-level accusations.

The court documents show that Trump intends to embrace the legal arguments made by his fellow racketeer co-defendants Kenneth Chesebro, Rudy Giuliani, and Ray Smith.

Giuliani filed an appeal, requesting that Fulton County Superior Court Judge Scott McAfee throw out the indictment because it has "deficiencies," according to his attorneys, which make it invalid.

The pro-Trump attorney Chesebro, who created the "fake electors" scheme, filed a similar objection last month, claiming the indictment "fails to sufficiently set out the charge or any violation of the law."

These motions are frequently made at the beginning of a criminal case and rarely succeed.

Smith, a lawyer representing Trump's 2020 campaign in Georgia, submitted a lengthy document contesting the indictment, claiming that it had "voluminous" errors and that the state had failed to comply with the racketeering laws.

While he has hinted in court documents that he would ask for the matter to be transferred to federal court, where he can attempt to invoke safeguards for federal officials, the former president requests that the state charges be dropped.

The expansive indictment filed by Fulton County District Attorney Fani Willis last month against Trump and 18 co-defendants for their roles in attempting to overturn Georgia's 2020 election results includes 13 counts against him, including racketeering, conspiracy, and soliciting a public official to violate their oath of office.

All the defendants, including Trump, Chesebro, Smith, and Guiliani, have pleaded not guilty.
