Supreme Court Halts Implementation of Texas Immigration Law Temporarily

    2024-03-05

On Monday, the Biden administration officially requested the Supreme Court to prevent Texas from implementing an immigration law known as SB4.

SB4 would grant state law enforcement the authority to detain migrants suspected of unauthorized entry into the United States and enable state judges to issue unofficial orders to remove individuals suspected of violating the law.

Recently, U.S. District Court Judge David Ezra approved a petition from the Justice Department and the American Civil Liberties Union, temporarily stopping Texas state authorities from enforcing SB4. Judge Ezra underscored that immigration-related arrests and deportations fall under federal jurisdiction, dismissing Texas' claims of facing an "invasion" by migrants.

Following a request from the Justice Department on Monday, Justice Samuel Alito of the Supreme Court halted the 5th Circuit Court of Appeals' order until Wednesday, March 13. Texas was granted until the close of business next Monday to present its case. If the Supreme Court rules in favor of Texas, SB4 may become enforceable on March 13 at 5 p.m. Eastern Time.
