The first installation of a DOT-approved permanent outdoor dining structure in New York City appeared this week on 9th Avenue.

Installed by STREETSEATS , the modular structure is currently being used by Lovely’s Old Fashioned and serves as a prototype model for other restaurant owners to check out in person.

Over the next few months, we are likely to see more changes to outdoor dining setups in Hell’s Kitchen. An August 3 deadline has now passed for restaurants participating in the temporary program to have their Open Restaurants-era setups grandfathered into the permanent program.

Any restaurants that have dining sheds from the temporary program but did not apply for the new program will have to start removing those structures. Restaurants not currently participating in the previous temporary program can still file applications for Dining Out NYC with the DOT.

STREETSEATS was created by Evan Collier and the award-winning custom design and fabrication team from ARCH Production & Design NYC. Co-founder Ryan Taylor told W42ST, “We are on a mission to transform the urban outdoor dining landscape in New York City.”

The module at Lovely’s contains two high top tables and bench seating along the back. Panels on either side of the entrance sport Lovely’s logo, and a plexiglass panel at the back features the slogans “Made with Love” and “Open Late”. The structure is topped with an angled corrugated metal roof.

In addition to providing DOT-approved outdoor dining systems, STREETSEATS is currently the only company in the state providing full management including design, fabrication, installation, maintenance and storage. Evan explained that their modules provide the largest amount of square footage possible and come with a 10 year warranty.
