Supreme Court rejects Biden’s Title IX regulations in states where governors oppose

The Supreme Court denied the application of President Joe Biden's new Title IX sex discrimination and education regulations in states where courts blocked them in a 5-4 decision Friday.

Associate Justice Neil Gorsuch joined the three progressives on the court in dissenting.

The Biden administration requested the nation's top court enforce parts of a new federal rule meant to protect LGBT and pregnant students from discrimination in 10 states where the rule was put on hold by federal judges.

All justices agreed the disputed changes, including the new definition of "sex discrimination" to include "gender identity" and the restrictions on same-sex spaces, could remain blocked.

"All Members of the Court today accept that the plaintiffs were entitled to preliminary injunctive relief as to three provisions of the rule, including the central provision that newly defines sex discrimination to include discrimination on the basis of sexual orientation and gender identity," the Supreme Court said in its unsigned opinion.

The Biden administration intended to expand Title IX's protections to LGBT students with the new regulations.

Conservatives celebrated the decision on social media.

"Not all Supreme Court justices know what a woman is, but enough did today! Lets goooooo," former University of Kentucky swimmer Riley Gaines posted on X.

Sen. Marsha Blackburn (R-TN) and Rep. Mary Miller (R-IL) also commended the court's decision. Blackburn said , "I am pleased to see the Supreme Court siding with the rule of law—and basic common sense—in blocking the Biden-Harris administration’s dangerous Title IX reforms. We must always protect real women."

Others weren't as pleased.

"By a 5-4 decision, the Supreme Court has decided, once again, that the constitution doesn’t apply to trans people," Stacy Cay, a transgender comedian, posted on X.

Gender and women's issues have been made a top issue this election cycle as Republicans and Democrats tussle over transgender and abortion rights.

Former President Donald Trump has suggested he will prevent biological men from taking part in women's sports, while LGBT voters have largely backed Vice President Kamala Harris.
