Stafford County Sheriff’s Office reported two close-call DUI arrests on Sunday where the magistrate denied bond.

    Seven priors

The first incident occurred at approximately 3:44 a.m. at the Holiday Inn at 20 Sanford Drive.

According to SCSO, a call came in advising a drunk person had gotten behind the wheel of an SUV. Deputy M.N. Sayegh responded and reportedly found 35-year-old Hassan Naeem of Georgia behind the wheel sleep with a Mike’s Hard Lemonade sitting next to him.

According to SCSO, not only was the vehicle running, but it was in drive, and “the only thing preventing it from rolling forward was the driver’s foot on the brake.”

SCSO said deputies were able to wake Naeem up but he fell asleep again before they rectified the risky situation. After waking the man up a second time, SCSO said they got him to park the vehicle and get out.

He thought he was in Georgia, SCSO reported. And when deputies mentioned field sobriety testing, he allegedly told them he “would never pass.”

SCSO said it was discovered that Naeem had seven previous offenses.

He was charged with felony consecutive driving under the influence within 10 years, refusing testing: 2nd offense, and drinking while driving.

He remains in Rappahannock Regional Jail without bond.

    Children on board

Later that evening, at about 3:14 p.m., a Park Police officer reportedly observed a vehicle that swerved into oncoming traffic multiple times.

Stafford Deputy J.J. Holetzky responded to the incident in the area of Garrisonville Road and Rock Hill Church Road.

The driver was identified as 55-year-old Martin Magallanes, of Stafford. And, SCSO reproted he had two children in the backseat who weren’t properly buckled in.

SCSO said Magallanes admitted to drinking tequila before getting behind the wheel and he showed signs of intoxication.

His charges included DUI with a blood alcohol content above .2 while children are present, reckless driving, two counts of felony child neglect, transporting a child without a child restraint device, and an expired registration.

Initially, Magallanes was held at Rappahannock Regional Jail without bond. Court records show he had a bond hearing yesterday, and he is no longer listed as an inmate.
