CLARKSBURG, W.Va. (WBOY) — After hearing from five different witnesses for over five hours, a conclusion has still yet to be made from the City of Clarksburg regarding its suspended fire chief Stephen McIntire.

The first hearing in front of the city’s Civil Service Commission was held back in July following his suspension in June , and the second hearing took place at 10 a.m. Tuesday, Sept. 3 in Clarksburg’s city hall.

McIntire was terminated due to using unapproved funding for a mural in his office, according to a termination letter he received as well as confirmations from City Manager Tiffany Fell.

During Tuesday’s hearing, 12 News spoke with Chief McIntire’s attorney, Joshua D. Miller of Toriseva Law, on their hopes for the hearings verdict.

“Certainly, I would hope that the Civil Service Commission would find it in favor of Stephen McIntire and giving us back his job and putting him back his position of fire chief of the city of Clarksburg,” Miller said.

Although city officials have confirmed that the case boils down to Chief McIntire using unapproved city funds for a mural project , documentation shows that McIntire also spent unapproved city funds on “air packs” and other fire equipment.

thats ridiculous he spent money on fire equipment? doesn't the chief have a budget to do such things? this doesn't sound quiet right. sounds like some home cooking to me. dont mess with people's livlihood. every department should be audited for all expenditures.

Yeah, all lawyers know full well if the city wants to get rid of someone and it don't matter if you were the Pope, you are gone...Goodbye Chief...
