GLENVILLE, W.Va. (WBOY) — A woman has been charged in Gilmer County after allegedly driving a vehicle while under the influence of methamphetamine with a child in her care.

On Sept. 13, deputies with the Gilmer County Sheriff’s Department were dispatched to the Dollar General on W.Va. Highway 5 East in Glenville for a welfare check on two individuals with a juvenile, according to a criminal complaint.

Deputies were informed that the woman, later identified as Michelle Leek, 43, of Glenville, “was acting strange.” When deputies arrived on scene, they said they found Leek putting a child into a car seat in the vehicle.

During that time, deputies said they saw that Leek was “struggling to load the child into the car seat as she wasn’t able to stop twitching.” Deputies then asked Leek to walk to their cruiser, and during the walk, deputies said she was “walking in a staggered fashion.”

When deputies asked Leek if she had taken any narcotics, Leek told them that “she smoked cigarettes,” and that she drove to the store because another individual “could not drive,” the complaint said.

After Leek was asked to perform a series of field sobriety tests, deputies said that she was “impaired and unable to operate the vehicle,” and placed her into custody, according to the complaint.

Deputies then read Leek her Miranda statement, after which, Leek told deputies that “she would not be able to pass a drug test and would fail for methamphetamine and THC.” Leek was then taken to Braxton County Memorial Hospital where she “would not stop moving as they were trying to draw blood,” deputies said.

The complaint noted that Leek has a previous charge for DUI from May of 2016.

Leek has been charged with DUI with a minor and child neglect creating risk of injury, and is being held in the Central Regional Jail on a $35,000 bond.
