WILKES-BARRE, LUZERNE COUNTY (WBRE/WYOU) — A popular Mexican Restaurant in Luzerne County is facing backlash.

This comes as the U.S. Department of Labor finds the owner of La Tolteca Authentic Mexican Restaurant in Wilkes-Barre withheld tips from 51 employees and now has to pay back $1.3 million.

PSP warns residents of recent scam

Investigators found the owners had the servers and bartenders give a percentage of their tips to the restaurant without a record of how tips were being used instead of giving them to a valid tip pool.

Investigators say they also found the owner did not pay some of its salaried cooks overtime.

This restaurant makes a killing, specially on the weekends. So many people have to wait for hours to get a table. The food is really really good... they have one location at the Wilkes Barre square as well. It's not fair to take the waitstaff's tips, they all share the tips with the busboys as well. But that money is for them and not for the owners or managements. Now the owner is going to raise the prices to make some money back.
