SURFSIDE BEACH, S.C. (WBTW) — The owner of a Surfside Beach CBD store is appealing the town’s decision to suspend his business license following the arrest last month of two people for allegedly selling marijuana from the store.

Surfside Beach Town Council will conduct a hearing on Oct. 10 to consider revoking the business license for the Delta Dispensary located in a strip mall at 327 N. Highway 17 Business, Mayor Robert Krouse said Friday in his weekly email newsletter.

Authorities charged Jason Joseph Papotto, 46, and Sabrena Lee Papotto, 45, with two counts of distribution of marijuana and two counts of distribution of marijuana in proximity to a school or park.

“This is something different for the town,” Krouse said, adding that the owner “is exercising his right to an appeal before Town Council.” The hearing will be open to the public.

The arrests were part of a three-month-long investigation that focused on the sale of “unregulated and untested substances that were represented as hemp,” Surfside Beach spokesperson Tabitha Mull said after the arrests.

“A forensic analysis of these products indicates they are well in excess of the state-regulated limits for THC, containing significantly higher amounts of the compound and thus meeting the definition of marijuana,” Mull said. “South Carolina statutes do not currently allow for the possession or sale of cannabis or hemp products that contain over .30 percent of THC.”

Delta Dispenary’s Facebook page describes the business as a “family owned and operated premium cannabinoid dispensary all hemp derived.”
