Two men had been driving ATVs in a parking lot of the apartment complex when one of the vehicles became disabled. As the men attempted to fix the ATV, another man, later identified as Lynch, told the men to leave the premises. Lynch allegedly returned to his apartment, retrieved a firearm and fired one shot at the men, striking 28-year-old Erik Quiroz.

Upon arrival at the scene, the officer discovered Quiroz had been shot. Witnesses said Lynch left on a motorcycle and was later stopped by another officer. Quiroz was transported to Miami Valley Hospital where he succumbed to his injuries.
