    2 men acquitted of charges due to insufficient evidence

    DAYTON, Ohio ( WDTN ) — Two men have been acquitted of several charges including murder.

    Riyadh Pate, 20, and Lawrence Davis, 23, have been acquitted of several charges in connection to an armed robbery. Davis, Pate and two others forced their way into an apartment on Superior Ave. in June last year.

    During a shootout that ensued, one of Davis and Pate’s associates was killed. They were charged with his murder.

    After a trial began last week, their defense lawyers moved for an acquittal, which was granted on Monday. The judge said there was insufficient evidence to sustain a conviction.

    The acquittal applies to counts five through eight of their incitements . Their trial on the remaining charges, including two additional counts of murder, is set to begin in January.
