Fall Festival goer accused of assaulting a minor in line for a ride

HENDERSON, Ky. (WEHT) — An Evansville woman is in custody after police say she grabbed a minor by their throat at the West Side Nut Club Fall Festival.

Police say they observed a 12-year-old juvenile approach Kristin Burnett, in a non-threatening manner, before Burnett allegedly grabbed her by the throat and “forcibly push her against the gate of an amusement ride.”

Another individual in the altercation, Michael Flemming, allegedly grabbed onto Burnett and would not let go for detectives to detain her.

Police say the juvenile heard people yelling behind her about someone possibly cutting the line, and she apparently tried to offer Burnett her spot in the line to de-escalate the argument. However the juvenile did not think Burnett heard her and says when she approached her, Burnett assaulted her.

Burnett was charged with Battery, Strangulation and Disorderly Conduct.

Flemming was charged with Battery, Resisting Law Enforcement and Disorderly Conduct.

Both have been booked in the Vanderburgh County Jail.
