    North Aurora man sentenced to 8 years for deadly DUI crash in Batavia

    CHICAGO — An eight-year prison sentence has been handed down to a North Aurora man involved in a DUI crash that left a motorcyclist dead in May of 2023.

    40-year-old Luis Aca Osorio was handed the sentence after pleading guilty to aggravated driving under the influence of alcohol causing death, Kane County State’s Attorney Jamie Mosser announced Monday.

    The charge stemmed from a crash that prosecutors said unfolded just after 5 p.m. on May 7, 2023, in Batavia.

    An initial report by police indicated that Osorio was heading southbound in a van in Batvia when he rear-ended a motorcyclist who was driving in front of him in the 400 block of South River Street.

    Police said the motorcyclist was ejected in the crash and became pinned underneath the van. He was taken to the hospital in critical condition and later died from his injuries.

    According to prosecutors, police found Osorio stopped a short distance from the crash scene and believed he may have been impaired.

    After submitting to a breath test, prosecutors said Osorio was found to have a breath alcohol concentration of 0.204.

    “This entirely preventable traffic crash is another reminder that drinking and driving cannot only happen at any time of the day, but that it can have fatal consequences. I would like to thank the Batavia Police Department, victim advocate Linda Hagemann, Alliance Against Intoxicated Motorists Advocate Carrie Kilpatrick, and ASA Kelly Orland for their – more – assistance in this case. I would also like to thank the victim’s family for their kindness, patience and understanding throughout this process. Today, I hope that they got the justice that they feel they deserved and can finally close this chapter of their lives to move onto the impossible task of healing the wounds left by the loss of their loved one. Driving Under the Influence will not be tolerated in Kane County, and I believe that this negotiated sentence sends that message clearly,” Kane County Assistant State’s Attorney Katy Flannagan said in a news release.

    Osorio must serve 85 percent of the sentence in accordance with state law and will receive credit for 24 days served in the Kane County jail.

    That’s bullshit eight years for killing somebody!! and he had how many DUIs already!! he should’ve got manslaughter at least 15 to 20 years
