A Cincinnati-area man is accused of killing an elderly man during a confrontation at an Amtrak station in Nevada, officials said.

Jacob Pendleton, 34, is charged with open murder, a charge used in Nevada meaning he could face prosecution for counts ranging from first-degree murder to involuntary manslaughter.

Officers responded to the Amtrak in Winnemucca, Nev., on June 10 for a report of someone needing medical assistance, police said in a news release.

The officers found Michael McClure of Caldwell, Idaho, lying unconscious on the train platform, the release states. Witnesses told police that Pendleton had been waiting for a train to arrive when he shoved McClure to the ground.

Pendleton was arrested and initially charged with abuse of an elderly person, however, McClure later died at the hospital, police said, adding the death was "quite possibly" caused by injuries McClure sustained during his fall.

Records show Pendleton is currently detained at the Humboldt County jail without bond.
