BROOKHAVEN, Miss. ( WJTV ) – Protesters are concerned about corruption within the Brookhaven Police Department, and they’re calling on the U.S. Department of Justice to intervene. This comes after a former FedEx driver said he was shot at by a father and son while delivering a package in January 2022.

A hearing will be held on Thursday, October 10 to see whether D’Monterrio Gibson’s case goes before a jury following last year’s mistrial . His supporters said there’s still evidence being withheld by the Brookhaven Police Department.

A mistrial was declared in August 2023 after Detective Vincent Fernando, with the Brookhaven Police Department, left out crucial evidence during the pretrial.

“At the heart of this corruption is the fact that the shooters, Brandon and Gregory Case, are directly related to prominent members of the department. The former Assistant Chief Chris Case is a relative of the shooters and lead investigator Clint Earle, who outright refused to investigate the case, is married to their cousin,” said Danyelle Holmes, with the Poor People’s Campaign.

Gibson was not wounded during the encounter on January 24, 2022. Brandon and Gregory Case were charged with attempted first-degree murder, conspiracy and shooting into the vehicle driven by Gibson, which did not have a FedEx logo.

“It’s a bigger issue here. I don’t want anybody to get emotional about what we’re saying and what’s going on. We are so focused on getting justice for me and the other families that have never received justice regardless of their skin tone. The true enemy is the Brookhaven Police Department,” said Gibson.

He hopes the judge decides to keep Fernando’s testimony as the case moves forward.

Local organizations in support of justice for Gibson are calling on the Justice Department to intervene and do a clean sweep of the Brookhaven Police Department.
