UPDATE (10:28 p.m.): Mobile County District Attorney Keith Blackwood said he’s noticed Prichard Police Detective Jason Hadaway make false statements while under oath in court and launched an investigation ultimately resulting in his arrest.
Hadaway was arrested Wednesday morning and charged with third-degree perjury, which is a misdemeanor in Alabama.
Blackwood says he’s been investigating Hadaway for a month, and he turned his findings to the Attorney General’s Office, who are now leading the investigation.
“It was completely provable that he told false statements to prosecutors at this office,” he said.
Blackwood explained that since the investigation is in the hands of the attorney general’s office, he can’t elaborate on further details, but he did explain that his office had enough reason to believe that he was lying under oath during a court proceeding.
“He was under oath, and he made some statements that we felt like the attorney general’s office needed to take a look at and initiate an investigation into which is what they did.”
Blackwood elaborated a bit on the kinds of statements Hadaway made to receive the perjury charge.
“There’s two different false statements here,” Blackwood explained. “They’re statements that were to prosecutors in this office, not under oath that we knew that we knew to be just complete lies. It was completely provable that he told false statements to prosecutors at this office. That’s what we disclosed to two defense attorneys. Now, the second set of falsehood from Detective Hadaway, he was under oath. He was testifying in a proceeding.
“Our prosecutors came to me, and we talked about it. I decided that for us to prosecute that would be a conflict because of the falsehoods that he had previously told to our prosecutors that sort of underlie the testimony that he was giving under oath.”
With Hadaway being a lead detective in the department, Blackwood said this arrest could impact previous cases and prosecutions.
“It’s not going to be hundreds, but we expect some post-trial litigation or post-plea litigation,” he said. “There are a handful of cases pending right now. As I stated before, there was a long period of time where Detective Hadaway was not authorized to sign felony warrants. So that’s going to mitigate some of that.”
Hadaway was under scrutiny in August after he failed to appear in court for a preliminary hearing for a murder. That ultimately led the case to be dismissed.
We reached out to the Prichard Police Department and the Attorney General’s Office for comment, and we have not heard anything back.
Detective Hadaway will be tried for his misdemeanor in District Court in Mobile.
