UPDATE (1:32 p.m. on Friday, Oct. 18): The mother and grandparents of Kyneddi Miller, a 14-year-old girl who was found dead on a bathroom floor “emaciated to a skeletal state,” have pleaded not guilty to murder.

This happened in Boone County court on Friday afternoon. Julie Miller—Kyneddi’s mother—and Jerry and Donna Stone are facing charges of murder by a parent, guardian or custodian by failure or refusal to provide necessities and child neglect resulting in death.

The court pleaded not guilty on Jerry Stone’s behalf due to the fact that his, “mental capacity is in question.”

They are all requesting discovery in this case.

Their trial dates are scheduled for Dec. 10.

This comes one day after Julie Miller’s attorney, Ron Walters Jr., filed a motion to move the trial out of Boone County. No action was taken in court on Friday.

BOONE COUNTY, WV (WOWK) — Julie Miller, the mother of a 14-year-old girl who was found dead on a bathroom floor “emaciated to a skeletal state,” wants to have her trial moved out of Boone County, according to her attorney, Ron Walters Jr.

Court documents say they believe a fair and impartial trial cannot be done in Boone County due to alleged prejudice against Miller.

They argue that “pervasive” media and news coverage will make it almost impossible for an impartial jury to be assembled.

The court documents also bring up press conferences done by Gov. Jim Justice’s office and other state agencies, as well as investigations going on around Miller’s case that have been covered by news outlets.

If the court decides the motion is too early, the defense is asking for a pollster to canvas the judicial circuit to see what people think about Miller’s case, according to court documents.

Kyneddi’s mother, Julie Miller, and her grandparents, Donna and Jerry Stone, were all indicted on charges of murder by a parent, guardian or custodian by failure or refusal to provide necessities and child neglect resulting in death in September.

Boone County Prosecuting Attorney Dan Holstein said in August that Kyneddi had been on the floor where she was found dead for four to five days. He went on to say that describing her state as “emaciated” was not an exaggeration, comparing her malnourishment to images of Holocaust victims.

A close family member told law enforcement that Kyneddi had an eating disorder and had not been eating for months, according to the criminal complaint. It said she was unable to function on her own for almost a week due to her physical state.
