    Cody Rhodes, WWE, & Fanatics Sued Over ‘American Nightmare’ Trademark

    Cody Rhodes and others are now being sued over the use of the “American Nightmare” trademark.

    According to Brandon Thurston of POST Wrestling , a lawsuit was filed on Wednesday in the federal court of California against Cody Rhodes, WWE, and Fanatics by the lead singer of American Nightmare, Wesley Eisold.

    Eisold formed the American Nightmare band in 1998 and they recently toured last year. A filing with the U.S. Patent and Trademark Office reveals that Eisold registered for the “American Nightmare” trademark in 2016 for use in music, clothing, and entertainment services. Rhodes also started using the American Nightmare moniker in 2016. Whether the filing by Eisold is related to that or purely a coincidence is unknown at this time.

    Cody Rhodes attempted to trademark the term in March of 2019, but Eisold opposed the application. Two years later both parties agreed to a settlement in March of 2021 which allowed Rhodes to secure the trademark.

    The settlement detailed specific terms by which Rhodes was allowed to utilize the American Nightmare name on merchandise. Eisold is claiming these terms have been violated and is now seeking damages.

    Rhodes, WWE, and Fanatics have responded to this lawsuit as of this writing.
