    West Virginia State Senator arrested for DUI was allegedly driving erratically in a school zone while children were being picked up from school

    MARSHALL COUNTY, W.Va. (WTRF) — Following the arrest of Former West Virginia State Senator Michael Maroney on Monday, 7News has obtained the official’s criminal complaint regarding Maroney’s arrest.

    According to the complaint, McMechen Police say they observed a black Lincoln SUV driving erratically in a school zone while children were being picked up from school.

    McMechen Police say they attempted to conduct a traffic stop, and after some erratic driving, the Lincoln finally came to a stop.

    Upon approaching the vehicle, McMechen police say they observed that Maroney, the driver, appeared uncoordinated, was speaking quickly and slurring his words, and seemed to have a dry mouth.

    The criminal complaint states Maroney handed over expired insurance and registration and had difficulty finding his documents.

    When asked if he had taken anything, police say Maroney denied it. He was allegedly unsteady when exiting the vehicle and initially declined consent for a vehicle search.

    K9 units were called to the scene, and a search of the vehicle found negative results. Maroney was then subjected to various field sobriety tests, with mixed results.

    According to the criminal complaint, despite showing no impairment in some tests, he displayed signs of impairment in several others.

    A preliminary breath test showed a result of .000%, and Maroney refused to submit to a blood draw, leading to the obtaining of a search warrant for the test.

    Maroney was transported for the blood draw and subsequently taken to Northern Regional Jail to await arraignment.

    He has been charged with DUI drug, No Vehicle Insurance, and Expired Registration.

    This was Maroney’s second arrest in less than two months. He was arrested in August and charged with 2 misdemeanors of Indecent Exposure and Disorderly Conduct. That was in relation to an incident where Maroney allegedly engaged in an “overt act of sexual gratification” in a gambling parlor in Glen Dale.

    Maroney has pleaded not guilty to these charges and is scheduled to return to court at 2:15 p.m. on Nov 13 for both incidents.
