CHARLESTON, WV (WOWK) – A bill for a childcare tax credit in West Virginia has now passed the State Senate in a special session of the legislature.

The bill, HB 226 , passed the House of Delegates on Monday. It now awaits West Virginia Governor Jim Justice’s signature.

The childcare tax credit is one of the hot topic items brought before the special session of the West Virginia Legislature. House Speaker Roger Hanshaw (R-Clay) and Minority Leader Sean Hornbuckle (D-Cabell) introduced the bill on Sept. 30 before the special session went into recess .

This bill is designed to amend WV State Code to provide for a “child and dependent care credit against the personal income tax in the amount of 50 percent of the allowed federal tax credit…” This means anyone allowed a federal tax credit for child and dependent care under the US Code would also get a nonrefundable credit under West Virginia Code.

Once made into law, HB 226 will take retrospective effect for the current calendar year that began on Jan. 1, 2024.
