HANCOCK COUNTY, W.Va. A Hancock County, West Virginia man facing several felony charges, including escape from law enforcement, waived his preliminary hearing Thursday morning.

Herald-Star reports that the online case docket shows a motion to continue filed on Thursday regarding another 24 misdemeanor charges, including ten counts each of battery, obstruction of law enforcement and EMS, fleeing, and unlawful destruction of property, all stemming from a Sept. 23 incident.

According to the news outlet, on Sept. 23 of this year, officers attempted to serve Payton with several previous felony warrants, including one for escape.

This is when police say he allegedly became very aggressive and damaged a Chester police cruiser that he was being transported in.

It is reported that EMS was called after Payton shattered the windshield and wedged himself in a window while trying to escape the vehicle.

It is also alleged that he assaulted the first responders.

According to Herald-Star, the online case docket did not show any new hearings for Payton’s misdemeanor charges as he awaits extradition to East Liverpool, Ohio, for charges filed earlier this summer.
