    DoHS issues clarification on child care provider payments regarding federal rule change

    CHARLESTON, WV (WVNS) — The West Virginia Department of Human Services (DoHS) has been made aware of reports implying that child care centers are dealing with possible closures and funding crisis if the State does not take action by the end of August.

    The reports are inaccurate and this announcement is being released to provide clarification regarding the recent federal rule change regarding child care providers receiving payments.

    In late February, a federal rule change was enacted that required payments to child care providers to be calculated on enrollment rather than attendance. DoHS has paid providers by enrollment since 2020, through federal American Rescue Plan Act (ARPA) funds as well as federal Temporary Assistance for Needy Families (TANF) funds. DoHS has funding to pay providers using accessible TANF funds until they are fully utilized, which is expected to be at the end of the year.

    DoHS has made legislative members aware of the rule change, as well as its available funding through TANF. If completely used, other plans could be implemented, including the use of a new reserve fund created through the recent special session if it is necessary.

We are doing everything in our power to ensure stability for both providers and families, while including the Legislature as the appropriating body in discussions regarding budgetary and funding items.

    Though some have suggested that the funds held in the reserve could potentially be utilized to cover any gaps, leaders have been transparent that the purpose of the reserve funds was for use if needed prior to the Legislature meeting and taking further action. As TANF funding will not be depleted before the year is over, there are many months when the Legislature may meet and seek appropriations.

    As previously stated by DoHS, if changes to child care qualification rules become needed, DoHS will issue a written notice 60 days in advance to families it will affect. No notice has been issued at present, and DoHS will continue its efforts to maintain this crucial support.
