WHITE PLAINS, N.Y. - A 21-year-old Yorktown man who purposely ran a stolen ATV into another resident last summer causing serious injuries has pleaded guilty to second-degree assault.
WHITE PLAINS, N.Y. - On July 17, Kyle Frankkild pleaded guilty before state Supreme Court Justice Larry Schwartz. He was promised a sentence of “shock probation,” which includes six months in the Westchester County Jail and four-and-a-half years of probation.
On Aug. 27, 2023, Frankild was one of many riding ATVs and dirt bikes at Hunterbrook Ballfield where they were allegedly vandalizing the field. According to police, 64-year-old Ed Moffett approached them and told them to stop tearing up the grounds.
Frankild then ran Moffett down with an ATV that was reportedly stolen from Suffolk County in 2021.
Moffett told Yorktown News that he agreed to the shock probation and did not think sending Frankild to a state prison would help him in the long term.
“I’d like to see him become a productive member of society again,” Moffett said.
Moffett added that Frankild wrote him a letter apologizing for the incident, blaming the assault on issues with the ATV.
Moffett sustained serious injuries in the attack, including two broken ribs, a traumatic brain injury, and a double compound fracture in his right leg. In the wake of the incident, he had to be transported to the Westchester Medical Center by Advanced Life Support.
According to police, Frankild fled to a home near Route 202 following the attack and was later brought to the Westchester Medical Center by AMR Ambulance to treat injuries to his face which were allegedly sustained in the collision with Moffett.
Frankild was originally charged with first-degree assault, a Class B felony, leaving the scene of a serious injury auto accident, third-degree criminal mischief, and fourth-degree criminal possession of stolen property—all Class E felonies.
“We hope that Ed Mofett continues to recover from the physical and psychological damage inflicted by Mr. Frankild,” said Yorktown Police Chief Robert Noble.
Moffett said his injuries are a lot better now than they were, but there’s still some progress to be made.
“I’m walking again, but the worst thing is my brain isn’t 100 percent,” he said. “My memory is still messed up, I’m still not sleeping well. My emotions are still out of control, and I had a second surgery on my leg.”
