Texas Governor Greg Abbott is celebrating a court victory over the Biden Administration in a fight over a river barrier the state installed in the Rio Grande.

The U.S. Fifth Circuit Court of Appeals ruled that the floating barrier Texas placed in the Rio Grande last year to prevent illegal crossings in Eagle Pass may remain until the matter is decided in a lawsuit which will be heard in a District Court.

“The Fifth Circuit last night delivered a victory for Texas' historic border security mission by ruling that our floating marine barriers can stay in the Rio Grande River," Governor Abbott declared in a statement issued after the ruling.

"Last year, Texas installed these barriers to deny dangerous and illegal river crossings, and almost immediately, the Biden-Harris Administration sued to remove them and obstruct our efforts to secure our border. We fought to keep these barriers in the water, and ... that is exactly where they will remain. This fight is far from over. Texas will continue to defend our constitutional right to secure our southern border to keep our state and the nation safe.” -Texas Governor Greg Abbott

This "floating border wall" has generated controversy - and legal challenges - since Governor Abbott first announced his intention to install it in 2023:

First to challenge the million dollar river barrier was a private citizen, followed by the U.S. Justice Department. When the Biden Administration stepped in to oppose it Governor Abbott was defiant:

"We will see you in court, Mr. President." -Texas Governor Greg Abbott (July 21, 2023)

Following this week's court victory, the floating barrier will remain - at least for now. It's a battle Governor Greg Abbott has vowed to take to the U.S. Supreme Court if necessary.

Should Texas' "Floating Border Wall" be allowed to remain in the Rio Grande?
