SYRACUSE, N.Y. (WIVT/WBGH) – A Border Patrol Agent has been charged after ordering several women to expose their breasts to him while processing their admission into the United States.

On Wednesday, Attorney Carla Freedman and Vance Kuhner, Special Agent in Charge for U.S. Customs and Border Protection, Office of Professional Responsibility announced the arrest of Shane Millan, 53, of Jefferson County. He was charged with four counts of deprivation of rights under color of law.

It is alleged that Millan, while acting under color of law as a Border Patrol Agent, deprived four victims of their constitutional right to be free from unreasonable searches. While virtually processing their admission into the U.S., Milan allegedly instructed three women to expose their bare chests to him over webcam. He instructed the fourth woman to expose her breasts to him while her bra remained on.

During an investigation, it was determined that Millan told the women that these were legitimate searches and were required for admission into the country. However, his demands to see the victims’ breasts were for his own gratification.

Milan was arraigned in Syracuse and released pending a trial.
