    Sentence deferred after attempted assault on Bismarck officer

    BISMARCK, ND ( KXNET ) — A woman who kicked a police officer last year will not be serving her sentence.

    According to State Attorney Julie Lawyer, on October 2, 2023, Bismarck police officers were called to the area around Everspring Inn and Suites in South Bismarck after a report of an unwanted subject at the property. Upon arriving on the scene, law teams encountered Erin Tveito, who was allegedly intoxicated and uncooperative.

    Tveito was arrested on charges of Preventing Arrest and Providing False Information to Law Enforcement, and was taken to a local hospital to be cleared for jail due to alleged alcohol use. While in care, Tveito told the officer that she would kick him before doing so.

    After thirty minutes of court deliberation, the jury deemed Tveito guilty of Attempt to Commit Simple Assault on a Peace Officer. However, the presiding judge ordered a deferred imposition of sentence for 360 days, in which Tveito will be on unsupervised probation.

    A deferred imposition of sentence means that the court will not impose one, and that the case will be dismissed as long as other conditions are met. To avoid jail, Tveito must pay mandatory court fees of $560, and complete a chemical dependency evaluation.
