CLEVELAND (WJW) — The FOX 8 I-Team has uncovered new details about the murder of Cleveland police officer Jamieson Ritter .

This comes to light with a new push to make sure the suspect has no chance to get out of jail while waiting for trial.

Delawnte Hardy has been indicted for shooting and killing his grandmother and officer Ritter.

Hardy sits in jail held on a $10 million bond, so there’s a good chance he would never come up with the money to post bond.

But the Cuyahoga County Prosecutor’s Office has filed a motion with the court has asked a judge to have Hardy held without bond.

The motion reads, in part, “The State of Ohio submits that there are no conditions upon which the defendant can be released wherein the public will be safe. … Simply put, police officers should be kept safe from individuals who are known to shoot them to evade capture. Because this defendant has killed to avoid justice once, that fact must be recognized and acknowledged, and he must be held without bail until his trial.”

Investigators have said Hardy fired four shots as police tried to arrest him for shooting his grandmother.

The new court document includes chilling new information.

It says police did not immediately realize officer Ritter had been shot. One bullet just missed another officer’s head.

“The fourth shot was fired while several officers were holding [Hardy’s] left hand to the ground while still trying to disarm him,” it reads.

    No ruling has been made.

Defense lawyers get a chance to respond.

Hardy is due back in court for a hearing on Wednesday.

Cuyahoga County prosecutors have not decided if they will seek the death penalty.
