    Judge rules in favor of family in D20 special needs lawsuit

    (COLORADO SPRINGS) — On Monday, July 22, a judge ruled in favor of the family of a special needs student regarding a lawsuit they filed against Academy District 20 in Colorado Springs.

    The judge found the district violated the student’s Individualized Education Plan (IEP). She is nonverbal and requires numerous accommodations. According to our previous coverage in May, her father, Ronnie Broyles, told FOX21 it is dangerous for her to attend in-person classes at Discovery Canyon Elementary School, and according to Broyles, the district told him either she needed to be present all day or she would not get special education services.

    “We are overjoyed this decision… went in our favor and feel that it vindicates our belief that the appropriate placement for Victoria was, and remains, in the home where she is safest,” said Broyles.

    When FOX21 reached out to the district for comment, they said, “Academy District 20 received the Administrative Law Judge’s decision late on Monday. The District is currently reviewing the decision and considering our options. As such, we appreciate your understanding and will not be making any further comments at this time.”
