A man has been arrested and charged with murder after Columbus police said he ambushed a man who was with a woman he knew, killing him.

Erik Wagner, 33, of the Northeast Side, was arrested Sunday afternoon.

Around 10:30 a.m. Sunday, Columbus police got a call about a man being shot on the 2400 block of Timber Trail Drive. Officers found Andrew Stephens with a gunshot wound to the head. Stephens was rushed to OhioHealth Riverside Methodist Hospital, where he died.

Court records say Stephens had driven a woman back to the apartment complex, and when the woman got out of Stephens' vehicle, Wagner came out from behind a tree and shot at Stephens.

"Mr. Wagner admitted to being there and was upset because (the woman) was his girlfriend and she was cheating on him with Mr. Stephens," Columbus police wrote in an affidavit.

The woman told police Wagner had been stalking for the past month.

Wagner is currently scheduled to have his first court appearance in Franklin County Municipal Court Monday.
