DAYTON, Ohio ( WDTN ) — The Montgomery County Grand Jury has indicted the man accused of setting a kitten on fire.

On Wednesday, July 17, about 10 days after the incident, Eric K. Williams appeared in court. The grand jury indicted Williams for knowingly causing serious physical harm to a companion animal.

Due to the involvement of fire, he was indicted on a second count of arson, for knowingly creating a substantial risk of physical harm to the property of another.

Per Ohio law, companion animals are considered property.

Williams was arrested by Dayton police after someone reported him. He allegedly told police that the kitten was playing with his pitbull, which frustrated him. He also denied setting it on fire.

The kitten has since been recovering at the Humane Society of Greater Dayton. 2 NEWS reached out to the Humane Society for an update on the animal and this is what we heard back:

The kitten is continuing to receive round-the-clock care from our veterinary team and we are currently discussing a long-term treatment plan as the kitten’s injuries were extremely severe.
