    Third trial attempt for capital murder of toddler may come soon

    WICHITA COUNTY ( KFDX/KJTL ) — A third capital murder trial may come before the end of 2024 for a Dean man accused of killing his fiancée’s toddler in 2018.

    Joshua Thomas Fulbright was booked into the Wichita County Jail on Friday, June 21, 2024, on a warrant issued from Clay County after he was reindicted for capital murder of a child under 10.

    The charge ste ms from October 2018 , when two-year-old Scarlette “Olivia” Newsom was hospitalized in Clay County with severe bruising to her head, arms, and back that authorities said appeared to be a result of abuse.

    Four days after she was admitted, the child died after she was taken off life support.

    A first attempt to try Fulbright in 2019 ended with a mistrial when a jury could not be seated in Henrietta out of a pool of 80 residents. His second trial in 2022 ended with a mistrial when his defense attorney was picked up on a DWI with a child passenger charge.

    After the second mistrial, 97th District Attorney Casey Hall announced her office would bring him to trial again to ensure justice for the victim, two-year-old Scarlette Newsom, who died after being taken off life support after suffering severe head injuries.

    Hall said the new indictment excludes the death penalty for Fulbright. She said she hopes to get the trial on the docket by late summer or early fall because she wants to finish this case before her term ends in December.

    “It’s the one case I feel like is unfinished business for me,” Hall said. “Scarlette needs justice and I want to make sure that happens.”

    Hall was unseated in the March 2024 primary election by Katie Boggeman, who will take office in January 2025.
