    Indiana man arrested for Jan. 6, U.S. Capitol Attack

    INDIANAPOLIS — A Clay County man was arrested on Wednesday for his involvement in the January 6 United States Capitol Attack.

    Nicholas Scott Ingram Hofer, 34, of Carbon, was arrested for assaulting law enforcement and other charges related to his conduct in the 2021 breach. He was charged in the District of Columbia with the felony offenses of:

    • Assaulting
    • Resisting, Impeding certain officers
    • Civil Disorder

    He is also charged with the misdemeanor counts of:

    • Entering and Remaining in Restricted Grounds or Buildings
    • Engaging in Physical Violence in Restricted Grounds or Buildings
    • Disorderly and Disruptive Conduct in Restricted Grounds or Buildings
    • Disorderly Conduct in a Capitol Building or Grounds
    • Committing an Act of Physical Violence in the Capitol Grounds or Buildings

    Hofer turned himself into the Federal Courthouse in Indianapolis on Wednesday.

    According to court documents, Hofer was identified in a crowd of rioters on the West Plaza of the U.S. Capitol building. He was later seen in a crowd of rioters that had breached a police line protecting the Northwest Stairs of the building.

    After breaching the line, Hofer went up the stairs and confronted an additional police line. He reportedly began pushing a bike rake barricade into the police line. As the police line moved up the stairs, so did Hofer.

    When rioters, including Hofer, reached the top of the stairs, they broke out two windows and the Senate Wing Door and jumped inside. When Hofer entered the building he raised his arms.

    At the top of the stairs, the rioters walked over downed barricades and approached the U.S. Capitol building on the Senate side. At approximately 2:13 p.m., rioters broke out two windows next to an egress-only fire door/emergency exit, often referred to as the Senate Wing Door, and jumped inside. The rioters then broke open the Senate Wing Door from the inside, setting off a blaring alarm and allowing rioters, including Hofer, to enter through the broken door. When Hofer entered the building, he raised his arms in the air.

    When in the building, Hofer reportedly picked up a wooden exhibit stand and threw it. Hofer, along with a group of rioters, later assaulted police further while attempting to breach the East Rotunda Door. Further, Hofer allegedly ripped a riot shield out of a police officers hand and passed it into the crowd. Another rioter then sprayed the officer’s in the eyes with chemical substances.

    When in the Rotunda, Hofer put his hands up, refused to leave, and stood in front of a police line for approximately 10 minutes. Officers eventually forced Hofer out.

    In total, Hofer spent an estimated 38 minutes inside of the Capitol building.

    More than 1,488 individuals have been charged in nearly all 50 states for crimes related to the breach of the U.S. Capitol.

    Hofer will make his initial appearance in the Southern District of Indiana.
