    Texas State Troopers executed a felony arrest warrant for a Graham man this week for criminally negligent homicide related to an Archer County wreck in October 2023.

    Texas Highway Patrol troopers executed the warrant Tuesday, Feb. 13 for Florencio Ramirez-Garcia, 66, of Graham, according to a release from Texas Department of Public Safety Sergeant Juan Gutierrez.

    The wreck occurred at approximately 12:36 p.m. Friday, Oct. 20. According to a preliminary DPS investigation, a 17-year-old Windthorst teen was traveling north on U.S. 281 in a 2019 Nissan Kicks with the driver of a second vehicle, Florencio Ramirez-Garcia, 65, of Graham, behind her driving a 2020 Ford F-250.

    A third vehicle, a 2014 Chevrolet Malibu driven by Autumn Jaclynn Roach, 21, of Fort Worth, was traveling south on U.S. 281 when the Windthorst teen slowed to make a left turn. Garcia failed to control the speed of his vehicle and struck the back of the Nissan.

    The Nissan spun into oncoming traffic and was struck by the Chevrolet Malibu. The teen was transported to United Regional Hospital in Wichita Falls and was later pronounced dead. DPS stated that it was unknown if the driver was wearing a seatbelt during the wreck.

    Garcia, along with his passenger, Atanacia Ramirez, 61, of Graham, were not injured in the wreck and were both wearing seatbelts when it occurred. Roach was injured in the wreck and was wearing her seatbelt when it occurred.

    According to the probable cause affidavit, there were multiple witnesses to the wreck.

    DPS troopers conducted a video speed analysis Nov. 2, 2023, after receiving camera footage related to the wreck, but not showing the actual moment of collision. The analysis showed Ramirez-Garcia was traveling at an average speed of 69 mph over two separate distances, which was 14 mph over the posted speed limit of 55 mph.

    Ramirez-Garcia was interviewed by DPS troopers Wednesday, Jan. 17 and stated he was traveling at a speed between 45-50 mph and believed the wreck occurred due to the 17-year-old not using a turn signal.

    “(Ramirez-Garcia) stated he was not paying good enough attention to the roadway. He stated he was looking for the speed limit signs because he knows the speed limit changes soon after leaving Windthorst,” the affidavit states. “He had just come out of a 45 mph zone, passed one 55 mph sign, and (was) approaching a second sign. (Ramirez-Garcia) stated multiple times that (the 17-year-old) was not using the turn signal, however the turn signal is visible in the video.”

    Ramirez-Garcia was booked into the Archer County Jail on $400,000 bond. The case will be submitted to the Archer County District Attorney’s Office.
