    4th of July means American pride, holiday plans and… firework tents?

    HENDERSON, Ky (WEHT) – With 4th of July right around the corner, people might stock up on American pride gear, get holiday plans finalized and prepare for a potential cookout, but there is one other part that everyone is familiar with: fireworks.

    It is summer tradition to celebrate America’s independence by shooting fireworks into the night sky and see all the colors and patterns they set off.

    To buy some, there are firework stores, but one might also notice tents of fireworks popping up to encourage one to stop by.

    To set up these tents, it isn’t as simple as one might think. It requires a process of requirements and permits before one is able to set up a temporary shop.

    Henderson Fire Marshal Matthew Anderson with the Henderson Fire Department says there are state requirements around retail sales and distribution of fireworks, both from a permanent or temporary facility.

    According to the city of Henderson ordinance code, an application for a “retail fireworks permit” must be submitted to HFD at least 15 days prior to the applicants desired date.

    Anderson explains that in the application, HFD receives copies of all appropriate licensing forms with the state fire marshal’s office, insurance and paperwork showing the tents and materials used that are certified to be flame resistant.

    The ordinance also states that firework sales must take place at least 300 feet away from a residence.

    Anderson also says he ensures that the proposed stands are to be in the proper zoning areas.

    If the 300-foot distance requirement is violated, the owner of the temporary tent will be cited and for $250 that must be paid within ten business days.

    Ordinance also states no one under 18 is permitted to sell consumer fireworks and the sale of fireworks can only take place between 8 a.m. and 10 p.m.

    Anderson also explains prior to the tent’s opening, the applicant receives their permit for display. Inspections to ensure appropriate pathways and travel distances, necessary fire extinguishers, safety plans, proper signage and other items are also conducted.
