    Lawsuit over fall at construction site in Lake Oswego dismissed

    A lawsuit that was filed against the city of Lake Oswego and contractors by a local resident who fell and injured themself at a construction site was dismissed.

    According to the initial complaint, filed in Clackamas County Circuit Court in 2022, Judy Carlisle tripped after stepping into an asphalt patch that had sunk at the corner of Lake Grove Avenue and Reese Road on Nov. 3, 2020 and suffered a fractured arm and a dislocated shoulder.

    The lawsuit claimed that Turney Excavation was negligent in not placing signage indicating the site was dangerous and that the city didn’t inspect the site to prevent the fall from occurring.

    However, the parties agreed to have the case dismissed earlier this year and Judge Kathi Steele issued the dismissal in May.

    The city had previously filed a crossclaim against Turney Excavation so that, if the city was found liable, the contractor would have to pay the city by that amount. The crossclaim also stated that the local government would be indemnified against the claims based on contract details.
