    Cease & Desist Order issued for Minot smoke shop

    MINOT, ND ( KXNET ) — A Cease & Desist Order was issued on Thursday, July 25 for a smoke shop in Minot.

    According to North Dakota Attorney General Drew Wrigley, the order is against Minot Smoke Inc., the owner, and manager of “Smoke4Less” in southwest Minot.

    The order alleges violations of the North Dakota Food, Drug & Cosmetics Act, the Uniform Controlled Substances Act, ND’s consumer fraud laws, and the Hemp Act.

    During a Bureau of Criminal Investigation undercover operation, employees sold products that contained marijuana, THC, and substituted tryptamines multiple times. These drugs are comparable to psilocin, which is a Schedule I hallucinogenic controlled substance.

    The labels do not have any disclosure or indication of their presence and, in some cases, even falsely represent that the product is legal and free of those substances.

    The Cease & Desist Order alleges that the store is unlawfully selling misbranded and adulterated products with misleading names, packaging, and descriptions of the products.

    “The mischaracterization of these products causes consumers to unknowingly purchase and consume dangerous psychotropic products,” Wrigley said. “The sale of these products is unlawful, creates a serious risk to the health, wellbeing, and safety of the public, and must stop immediately.

    Because of labeling, the actual ingredients can only be determined through lab testing by the BCI Crime Lab.

    “‘Smoke4Less’ and its management have been directed on multiple occasions to stop selling unlawful products, yet they continue to sell these products and disregard the harm they may cause,” continued Wrigley. “Our BCI and Consumer Protection and Anti-Trust Division will continue to investigate this type of conduct for as long as these unlawful products are being sold anywhere in North Dakota.”
