YORKTOWN, Ind. — A Muncie man was arrested Sunday afternoon after he reportedly got into an altercation with multiple people in the parking lot of a liquor store and nearby convenience store, including spitting on a woman while calling her a racial slur.

According to an affidavit of probable cause for an arrest without warrant filed on Sunday in Delaware County, 32-year-old Jeremy Evans was arrested on one count of battery with body waste, a Level 6 felony, and one misdemeanor count of disorderly conduct.

On Sunday, law enforcement officials were called to the Friendly Package location on Kilgore Avenue in Yorktown in reference to a fight. Callers to dispatch reported that a man was reportedly yelling at patrons of the liquor store and was throwing rocks, bricks and gasoline. Officials said later that the man was reportedly arguing with individuals in a truck that eventually left the nearby Village Pantry, a convenience store.

When law enforcement arrived on scene, they saw a shirtless man who “appeared to be distressed” as well as an older woman near the scene. The man was later identified as Evans and the suspect in this incident. The older woman was identified as a family member of Evans.

The documents state that as law enforcement was speaking with Evans, he “attempted to leave the area multiple times” and cussed at the family member, as well as the officer on scene. Evans reportedly used phrases like “f— the police” and told one officer on scene that he was “a q—- and like to look at a——-.”

Evans reportedly told officers that he had gotten into a fight with a “n—– b—–.” The person, who later returned to the scene, told officers that Evans was yelling, screaming and spitting at her while her two children were in the car. The witness also claimed that Evans kicked her driver’s side door and spat on her when she stood next to her car.

Other witnesses said that Evans was “acting erratic and attempting to fight everyone in the parking lot.” Evans was also reportedly harassing customers at the Village Pantry location and was using profanity.
