NEW ORLEANS ( WGNO ) — The re-sentencing has been delayed for the man who was found guilty of manslaughter in the killing of former New Orleans Saints player Will Smith.

Cardell Hayes was convicted of manslaughter with a firearm on Jan. 27 in the fatal shooting of Smith in a road rage incident eight years ago.

Hayes had been found guilty previously of killing Smith and wounding Smith’s wife, but the conviction was later thrown out because the verdict was not unanimous.

On April 25, a judge sentenced Hayes to 25 years in prison with credit for time served, which includes three years of house arrest. But prosecutors said Hayes cannot receive credit for those years.

Hayes was set to be re-sentenced on Monday, but it was postponed because of IT issues related to Friday’s nationwide technology outage .
