NEW PHILADELPHIA ‒ A New Philadelphia man will go on trial this week in connection with a fight at a residence within the city on Dec. 28.

Jerry Davis, 52, is charged with felonious assault, a second-degree felony. He appeared before Common Pleas Judge Elizabeth Lehigh Thomakos for a pre-trial hearing Monday.

The charges stem from an incident at a party in New Philadelphia in which Davis was allegedly involved in a fight with another man. Following the fight, the other man was hospitalized for 12 days with injuries which the prosecution said were a result of the fight.

At the hearing on Monday, Assistant Prosecutor Fred Scott offered Davis a plea deal. The charges against Davis would be reduced if he agreed to plead guilty to aggravated assault, a fourth-degree felony.

Davis' attorney, Anthony Koukoutas told the judge that Davis was not interested in entering a plea to a felony charge.

If convicted of felonious assault, Davis could be sentenced up to 12 years in prison.
