Two men are taking legal action against the NYPD following a chaotic scene in Wingate Park Friday. A notice of claim was officially sent to the City of New York and the NYPD late Tuesday afternoon in response to chaos that broke out in Wingate Park on Friday night. Witnesses tell News 12 they were wrapping up the "Dunkin Delight" community basketball tournament when four officers pulled up to the park. Romal Marcus, who was injured that night, tells News 12 that officers began rummaging through bags, in search of guns. When they found nothing, he says people in the park started recording. He says he recalls an officer knocking a phone out of someone's hand and from there, absolute chaos erupted. "I see one of the young guys being punched on, choked, tased, knocked on the floor, unconscious," said Marcus, describing how he saw police handling his friend, Sandrew Gauvy, who has since been charged with resisting arrest, obstruction of governmental administration and disorderly conduct. Marcus says he was also injured and forced out of his wheelchair by the police and left there. He says that claim was documented on video. In the notice of claim, attorney Stephanie Ovadia says her client, Romel Marcus, sustained "personal injuries, the full extent of which are yet unknown." She says both Marcus and Sandrew Gauvy had their "civil and constitutional rights violated," accusing the NYPD of negligence, carelessness, recklessness, false arrest, false imprisonment, assault, battery, excessive force and malicious prosecution.
