    Elderly woman on walk attacked by dog in neighborhood

    On July 17, 2022, the 66-year-old plaintiff was walking her dog in her neighborhood and placing dog treats on the porches of other known dog owners.



    As she was walking up to the porch of a house with a large German Shephard dog, the dog jumped through the window of the home and attacked the plaintiff, biting her dominant wrist and forearm, causing a wrist fracture and ligament injuries.

    The defendant’s homeowner’s insurance company attempted to argue that the plaintiff was a trespasser and that she provoked the dog.

    In opposition to this, plaintiff’s counsel, with proofs, convinced the adjuster of the incorrectness of her position, ultimately leading to an agreed upon settlement of $297,500, just $2,500 shy of the $300,000 homeowner’s policy limit.
