    11-year-old bitten by dog at friend’s house

    On July 23, 2022, the 11-year-old plaintiff was at his friend’s house, playing with his friend’s pit bull dog, and tossing a bone to the dog. The pit bull lunged at the plaintiff, attacked him and bit his face, causing lacerations to his cheek requiring stitches.

    The defendant’s homeowner’s insurance company attempted to argue that the plaintiff was provoking the dog by teasing him with the dog bone.

    In opposition to this, the plaintiff’s counsel provided direct evidence by way of ambulance records and emergency room records that recited important admissions regarding the incident to illustrate that no provocation was involved.

    Ultimately, a pre-suit settlement was reached wherein the plaintiff convinced defendant’s homeowner’s insurance company to pay the full policy in the amount of $100,000.
